Baker & McKenzie Sets Precedent in Public Procurement in Ukraine

Baker & McKenzie announced that it has successfully acted as Ukrainian law counsel to a leading international pharmaceutical company in a case against the Ministry of Healthcare of Ukraine regarding cancellation of the public procurement tender committee decision. The case was reviewed by the Antimonopoly Committee of Ukraine (AMCU).
On June 1, 2010, the Verkhovna Rada of Ukraine (Ukrainian Parliament) has passed the law on public procurement procedures, which empowers the market players to appeal the decisions of the tender committees regarding public procurement to the AMCU. This milestone case sets precedent on a new development of the Kyiv office's Competition law and Intellectual Property practice groups.
Commenting on the news, Antonina Yaholnyk, Partner and Head of the Competition law practice in Ukraine, said: "We are very pleased to inform about the new developments of our practice. Such a procedure can be applied as an efficient alternative tool by any market player involved in the public procurement proceedings to the traditional court hearing, being less time and effort consuming. We filed the case a month ago, and notwithstanding the fact that the defendant was the Ministry of Health of Ukraine, the decision was issued in favor of the international investor."
